Paternity Proceedings in Ohio
A paternity case is a one involving unwed mothers and fathers. When a child is born to a biological mother who is not married, the mother has full custody of the child. To establish custody or visitation rights, the father must file a motion to the court to establish paternity and a motion for custody or visitation rights. Even in cases in which the mother has sole physical and legal custody, a father may still have a right to visit with the child.
An unwed mother must initiate a paternity proceeding to establish paternity in order to receive an award of child support. To establish paternity, a DNA test of the father may be ordered if the father has not registered with the putative father registry within one month of the birth of the child. Once paternity has been established, the court may issue an order regarding custody, visitation, and child support.
