How Does an Uncontested Divorce Differ From Dissolution of Marriage?
In either a marital dissolution or an uncontested divorce, the couple is already in agreement about most or all of the major issues of the divorce — property division, child custody, child support, and spousal support.
If you and your spouse are close to agreement but a few sticking points remain, Mr. Morris can work with you to negotiate these final issues so you can take advantage of the cost-effective, time-saving option of an uncontested divorce. However, if any disagreements remain, your case could need to go to traditional divorce court.
A marital dissolution is slightly faster to accomplish than an uncontested divorce (as early as 30 days for dissolution, versus 42 for uncontested divorce). In dissolution, both parties must be available to attend the hearing, which takes place in family court or before a private family law judge.
In an uncontested divorce, although both parties must agree to the divorce, only one member of the couple must appear in court. This may be a good option if your divorcing spouse lives out of state or does not wish to appear in court. The party who will not be in court must sign all paperwork in advance.
