Why a Private Judge?

There are three primary benefits of working with a private judge on your uncontested divorce:

  • You avoid the public nature of appearing in Ohio Family Court. While your divorce will still be a matter of public record, you will not need to make a public appearance at the courthouse.
  • You avoid the delays inherent in family court. It is not unusual to arrive in court at 9 a.m., only to find yourself waiting hours for your case to be heard. When you work with a private judge, you determine the time you will meet and your hearing occurs at that time. It often takes only minutes for the hearing to be concluded.
  • You can choose the location of your hearing. Another highly convenient feature of working with a private judge is your ability to choose the location of your hearing — your office, your attorney's office, or another location.

Who Serves as Private Family Judges?

Typically, private judges are retired Ohio domestic relations judges. They are fully qualified and often have decades of judicial experience.

The Process of Working With a Private Judge

Attorney Richard Morris will file your divorce documents with the court and, at the same time, file a motion to have a private judge appointed. There is an additional fee for the services of the private judge. You and your divorcing spouse must agree upon a location for the hearing.

On the day of the hearing, you and your divorcing spouse will appear before the private judge and a hearing is conducted. The next day, Attorney Morris will file the paperwork with the Ohio Family Court, and your case is concluded. You will receive your divorce decree in the mail at a later date.
